The Messenger of Allah (may the peace and blessings of Allah be upon him) said, "A [virgin orphan girl should be consulted about [her marriage; if she remains silent, this is her permission, but if she refuses, there is no forcing her." The full story can be found in the hadeeth of Yazeed.
Abū Dāwood said, "This tradition has also been transmitted in a similar way by Abū Khālid Sulaymān ibn Ḥayyān, and Mu'ādh ibn Mu'ādh, on the authority of Muḥammad ibn 'Amr.
